Should Brookhaven Proceed With Century Center Annexation Vote?

The Georgia Supreme Court ordered a stay permitting the city to move forward Friday.

The City of Brookhaven can move forward with a vote on its proposed annexation of Century Center following a Georgia Supreme Court ruling last week.

The court issued a stay Friday on a DeKalb County Superior Court ruling that halted the annexation process, according to The Brookhaven Post.

The Order includes, β€œPutting aside the merits of the underlying lawsuit – whether the local law limits the authority of Brookhaven pursuant to general law to annex Century Center – it appears that Brookhaven and Highwoods are likely to succeed on the merits of their appeals from the entry of the interlocutory injunction, at least to the extent that the interlocutory injunction interferes with the legislative process by prohibiting the City Council of Brookhaven from voting on the annexation.
