Judge Halts Brookhaven Century Center Annexation

Brookhaven allowed to proceed with efforts if vote fails for Chamblee annexation.

A Dekalb Superior Court judge on Monday has denied Brookhaven's City Center annexation efforts for now.

Brookhaven and Chamblee are battling over the commercial development near I-85 and Clairmont. The Century Center is included in an annexation referendum that will go before voters Nov. 5 that would give Chamblee the property, though Brookhaven says it has legal rights to the development.

According to the Brookhaven Post, Brookhaven can proceed with its annexation efforts if voters in unincorporated DeKalb fail to vote in favor of annexation into Chamblee. Meanwhile, former Gov. Roy Barnes, who represents Brookhaven in the litigation, told the Dunwoody Crier that an appeal will be filed Tuesday.
