Judge Dismisses Pink Pony Lawsuit

Business wants to continue selling alcohol.

A DeKalb County judge has granted Brookhaven's wish for the Pink Pony’s suit against the city to be dismissed, ruling it has no legal merit.

The adult club filed suit in May after being prohibited by the city to sell alcohol. A city ordinance prevents alcohol sells in nude dancing establishments. 

“The city is very pleased that the DeKalb County Superior Court upheld Brookhaven’s sexually-oriented business regulations and resolved the numerous legal issues Pink Pony asserted in this lawsuit,” Brookhaven Mayor J. Max Davis said in a press release. “This confirms that the city’s regulations satisfy constitutional standards."
