The Judge's Order

As has been reported, Judge Story has issued an Order regarding the DeKalb Board of Education (DBOE).  I am attaching the Order so you can read it.

In short, it states that if Governor Deal decides to appoint a new member to the DBOE, that proposed member shall not be permitted to take office at this time. Moreover, if Governor Deal decided to remove a member, the member will remain in office but not be permitted to act on behalf of the DBOE or take any other official action.  

The purpose of this Order is to maintain the status quo until a hearing can be heard. The hearing will be Friday, March 1, 2013 at 2:30 PM at the Courthouse for the U.S. District Court for the Northern District of Georgia.  

WHAT DOES THIS MEAN?

It is NOT a decision on the merits.  It only means that the Court will hear arguments and that everything is held in abeyance until then.  In other words, it is possible that Governor Deal may still be able to appoint and remove members.  

I expect that the Court will make a quick decision after the hearing on Friday.

As evidence to SACS that the DCBOE is being held accountable, I pray Governor Deal moves forward with the suspension.

Gov. Deal creates a path forward today. First, he cut out the deadwood board members. Then he sets up a replacement nominating committee which will make recommendations for now open board positions. No power grab, simply a balanced path forward. Seem like a very reasonable approach to me. Finally we might get back to a board focused on education success.
