Jacobs Gives Details of Dunwoody Session & Reasons Why Media Wasn't Invited

State Rep. Mike Jacobs helped host an information session for Brookhaven decision-makers to offer them resources and tools as they embark on the tasks of starting a new city.

 

State Rep. Mike Jacobs (R-Atlanta) said he planned Monday’s informational session for Brookhaven council candidates and other Brookhaven leaders two weeks ago.

The purpose of the meeting, held at Dunwoody City Hall, was to serve as a “training seminar” for city council candidates, members of the Governor’s Commission on Brookhaven and the commission’s civilian committee co-chairs “to learn from people who were involved in setting up the City of Dunwoody and shepherding the Brookhaven Overlay District and the Perimeter CID into the success that it is,” Jacobs told Brookhaven Patch Tuesday.

What Was Discussed

During the session, attendees asked questions about the challenges Dunwoody faced as it moved towards cityhood and participated in two panel discussions, which were put together by Dunwoody Mayor, Dunwoody Chief of Police and Kim Duncan. The presentations were made by the Brookhaven Peachtree Community Alliance, which discussed the Brookhaven Overlay District and the Perimeter Community Improvement Districts, which described prospects for growth and transportation improvement.

Because Brookhaven is on a tight time schedule as it moves towards cityhood, Jacobs said he wanted to provide the candidates and leaders with more knowledge and resources since Brookhaven closely parallels Dunwoody.

Jacobs said the session would inform Brookhaven decision-makers that resources are available to them, like copies of the RFPs used by Dunwoody, so that “the wheel doesn’t necessarily have to be reinvented.”

“While there are some differences between the two cities, the reality is there no other new cities been down this road in the last four years with the same population, the same county and the same land size,” he said.

Why the Meeting Was Closed to Media

Jacobs said that because the meeting was educational, it was not subject to the Georgia Open Meetings Act. According to the Georgia Open Meetings Act, the session does not even qualify as a meeting.

According to one section of the act, “’Meeting’ shall not include the gathering of a quorum of the members of a governing body or committee for the purpose of attending state-wide, multijurisdictional, or regional meetings to participate in seminars or courses of training on matters related to the purpose of the agency or to receive or discuss information on matters related to the purpose of the agency at which no official action is to be taken by the members.”

 Although Jacobs did not explicitly invite members of the public, he told Brookhaven Patch that “members of the public would not be unwelcome” if they had shown up at the event and that some people he did not recognize as key Brookhaven decision-makers had in fact shown up on Monday.

Campaign staff members nor members of the media were allowed “so city candidates would feel free to ask their questions and get them answered and wouldn’t feel compelled to perform for the media,” Jacobs said. “Having the media present would not be conducive to an educational meeting.”

Although the session was closed to media, campaign staffers and not explicitly announced to the public, it does not qualify as a “closed meeting” as defined by Georgia open meetings laws.

“Obviously, transparency is important,” Jacobs said. “This wasn’t a meeting at which any decisions were made.”

In fact, this meeting was a pretty forward thinking idea for Rep. Jacobs to use some of the work previously prepared to move things along.

I am sure you will erroneously, yet uniformly agree this meeting was actually much like Malta talks whereby Party bosses divvied up post-WWII Europe.

General Oglethorpe, I agree with you that this is a non-story. I'm not sure why the Patch is giving it so much attention. There are plenty of other stories in the area that they can cover.

I don't see any comments from Bill Lowe on the first article about this topic, so I'm not sure why you're grouping him in. I understand that he has been critical of those leading the BrookhavenYES movement in the past, but I don't think it's fair to call him out on this since he hasn't commented on it yet.

Dunwoody officials, other city officials and state representatives---all of the same clique---have been involved at least since their Brookhaven cityhood events at Pub 71---including fundraising.

More so than any citizen-resident of Brookhaven.

Nothing "forward" about it.

Good people of Brookhaven,
Mike Jacobs is a sitting State Representative who has been hired by us to represent us, not some of the time, not when it's convenient for him, but ALL of the time. In doing so, he must carry out the charges of his constituency. Private meetings? Closed door invitation only? Whatever you may decide to call it. Quite honestly, it stinks to think these folks - no matter how insignificant THEY think these "non-meetings" are - its damned important to the people who these folks will represent and its damned important they practice what they preach and keep every bit of it open and accessible to everyone. This city was created under the pretext that we would be our OWN city. Not a copy/paste of Dunwoody which we are not.
Mike Jacobs has spoken so now its all ok? Mike Jacobs has tried to minimize what he should have explained BEFORE the MEETING took place. He comes out with a lame'o citation of the law and we are supposed to accept that as an excuse for his lack or moral fiber and character? People,
I have nothing to prove. I have nothing to sell you and probably nothing any of you want to buy. But what these cityhood folks told us and what made me decide to reluctantly vote yes, in hopes that there would be enough people out there who would support an initiative to hold these people to the high standards that they promised us during the cityhood campaign, is not getting off to a very good start. I for one will accept nothing less than I was promised. These promises were sold to us as absolutes. Unequivocal guarantees that "all of our dreams will come true"...and we will do this openly and honestly. So get right to it big boys and practice what you preach. The great people of Brookhaven deserve nothing less than the grandios schemes they were promised.

Here is what I take issue with, Mr. Jacobs:

You have and had a chance to decide that business as usual would not be the norm. No decisions were made, ok. Simply having the media there? YOU decided that for yourself? Why not start in a way totally unlike the dekalb co govt and INVITE the media, all of them? You know what you buy from skeptical people? Credibility.

It's one thing to steamroll political opponents on an issue. It's another to decide- on your own - why this meeting was closed.

Candidates for office- take your get ready pill because I WILL ask you if you attended this meeting, and WILL not vote for you if you keep attending them without insisting that the meetings have the media there.

Get the picture? Or is it too transparent?

I got to say that I think some of these candidates would have started performing in an effort to get their name in the paper, alternatively it might have made others shy about asking a question that could appear stupid. So I do see why such a training session benefits from keeping the media out.

Bottom line we've got more candidates than you can fit in a Volkswagen. So while I expect good transparency I think if anything other than information/education was being presented at least a couple of the slew of candidates would let us know about it.

Eddie, Ha! though I only meant the analogy as to it being crowded though I agree the full analogy applies regarding the primary - BTW we were talking about the cost of having to do a runoff in Brookhaven in another thread. Am I the only one who thinks doing a presidential primary and then a general primary statewide every 4 years is a waste of money? Think about how much money was spent just so Georgia could try to be one of the states with an early primary. And then what did we do? We wasted it by being only one of two states voting for Newt. Though i got to say even Newt is better than stench*

Also, when can I expect a response back concerning district questions that I have emailed you about back in August? You told me to contact you ANYTIME.
Also, you told me at a meeting that you would have NO MORE involvement with the new city details or formation. You were done.
Also, another meeting that you were at, you made all candidates leave and then said, "No one that voted against the city should be elected as mayor or hold city council member positions."
This is nonsense! You are a piece of work!
If city hood was on the ballot in November like it should have been, it NEVER would pass. This is sooooo wrong.

Please do not fret. Salvation lay within the city charter right? One could be led to this conclusion by sipping from the jug of hand stirred cool-aid. Next time you talk to Mike, perhaps he could enlighten you on his involvement with the media during the city campaign influencing them to not run stories that could be damaging to the whole debacle he was leading. I recall a quote by Rebecca Chase Williams that the CVI was "above her pay grade". Another interesting item was when Mike directed Ted Bagett with the CVI on the outcome he was looking for in the CVI Study and he told Ted to make the numbers look like there would be a tax savings for the wealthier folks in the proposed city. But you see, there's no funny business here. Just status quo. Right Mike?

I am not concerned, I know Mike Jacobs is not trying to do anything underhanded, his motives are clearly stated and I believe him.

So often we become jaded, and for good reason. This meeting doesn't concern me, on it's face. If I see sets of meetings with other cities, all closed to the media, I might feel differently.

The post follows a series that attempt to create a buzz over 'a clandestine conspiracy theory,' which is nonsense. The motives for incorporation are well known, that you choose not to believe them is OK by me. But if you want to change something, push away from the keyboard.

I've got a question, not related to this but I'll put it here. Reading this article about how much Jeff Rader's district still has for purchasing Park Land from the Park's Bond funds can anyone tell me where District 1's money was spent? Is this tied up in the whole debate about whether it was "promised" to Brookrun if it was mostly allocated to that area then WHY IN THE WORLD did it all go to one corner of the district? Note this has nothing to do with the tired "they are spending our $$ in South DeKalb" as its solely regarding District 1 funds.

I also note that the part of Brookhaven in District 2 I assume will not benefit from the leftover funds in District 2, understandable and perhaps a card that should have been played by the No folks. Though it seems that money was going to go along the Lavista Oak Grove vicinity anyway.

I'm not aware of how all the District 1 money was spent, I do know that $400,000 was spent on concrete driveways for the baseball league, which was a project that came out of the blue to the surrounding community.

You know what would be nice? To have a Government Webpage that tracks Capital spending for departments like Parks especially for things like Bond Proceeds. I hope the City of Brookhaven if we ever get a capital fund up and running will create online data to allow citizens to track how the money is being spent. Dunwoody has some nice financial reports online.

Call Susan Hood at (404) 371-2082 for details of how the development portion of the bond and grant money has been spent. Those are not on the web site. She should also be able to tell you how the unspent portions of these funds are allocated.

Did not some of the money get used to resurface the tennis courts at Blackburn and to rebuild the Murphey Candler pool and lake?

Thanks BM but that list sucks. Thanks for the phone number but I wasn't really looking to call someone, I'm curious, and would like it if there was an accessible way for all citizens to keep track. Unfortunately I think its a bit of a waste of county staff time for me to individually call them with a passing interest in how the bond funds were spent. Though thank you for the contact number should something come up that makes me specifically question something.

The lake dredging was funded by federal transportation funding. Nothing else has been done to the lake other than a couple of hay like rolls placed on the lake shore. And Northside funded that small deck.

As to the pool, that renovation was done about 10 years ago, i'm not sure if that is from the Bond Money. I know around 10 or 15 years ago some bond money was spent on new lighting for the ball fields, though I thought that was an earlier bond issuance, though I could be wrong.

Regarding the list does anyone know what the "metlife" green space is? sounds like it may be in the Perimeter Center, Dunwoody portion. And Perimeter trail? not sure where that is guess its near some portion of 285 in DeKalb.

Oh the Metlife perimeter Center appears to be something at that proposed TOD mega development on the corner of Hammond and Perimeter Center Parkway that was approved I believe over 5 years ago but has yet to be built. The chart says its only .01 million or $10,000 so perhaps its some right of way sliver they will landscape and thus justify calling it parks funding. Or maybe it was some sort of deal to build a pocket park .

I also see that the $330,000 for the Perimeter Trail was acquisition of parcels for The PATH Trail from Murphey Candler to Blackburn, or as they call it the Nancy Creek Trail. I thought that was all funded through the road money to widen that portion of Ashford Dunwoody when they replaced the Bridge over Nancy Creek but I guess they used some funds from this bond program to purchase part of the frontage from the neighboring properties for this road expansion that included the PATH Trail on one side instead of a sidewalk. Though $330,000 seems a bit steep.

Why is it important, since Brookhaven isn't Dunwoody? Can't have it both ways...

BTW, people are tremendously fallible, Brookhaven will experience missteps, mistakes, because of human frailty. Unlike the County, where a job is considered a 'right,' Brookhaven can replace a City contract employee for failure to perform with a phone call.

If an elected official fails to perform, Brookhaven citizens can judge that action, either in the form of an ethics compliant, or at the polls. Elaine Boyer got $20K sent to Lakeside Boosters, by Sembler. Lakeside Boosters is Elaine and her husband. Anyone ever call her on that?

Dear Georgia Mom, sorry if the above post sounds too bellicose. I just came from blogging on ESPN. The posts on the Brookhaven Patch are pale in comparison to the ones on ESPN. There are sick people there that said that they were glad went Joe Paterno died as well as the deaths of other sports figures as well. ESPN has teenage posters all the way to college professor, engineers, lawyers and doctors. You just never know who will be posting from minute to minute. Please hang in here with us. Thanks.

There is a super-cynical part of me that wishes to believe HamBurger and his/her/it's acolytes want to see Brookhaven fail, they really do, and they post here to promote that failure.

Why?

There are rumblings that S. DeKalb and Tucker want to incorporate and Brookhaven's inability to follow the successes of other new cities would stymy that effort.

At least EddieE admits all he wants to do is change his Complaint Line speed dial to a local Brookhaven number. I wonder if his posts will record better service and more effective service with Brookhaven?

Emmie, the burden of proof to deliver on the big bold promises of a new city, higher services, lower taxes, more ethical and responsive leadership, lies squarely with the Yes organizers. Now, please convince me this will happen. I am for all of these outcomes if they can be achieved. My heartburn has been the non-inclusive, non-transparent, lack of community education, the rush job and hijacking of the political process using flawed data. EPU I have read your comments over the months with mild amusement, but more often, with candid appreciation that a closed mind is incapable of new ideas.

You are right we have 'big bold promises':

- New city. Well that much is easy, Brookhaven is planned to start, and I would be surprised if that fails to materialize.

- Higher services. More like improved service levels, but let's not quibble with words. Each new City has done this, unequivocally. Big items like cleaning up dilapidated apartments so that law abiding residents can live safely, in a cleaner environment to leveling the crime rate. Brookhaven residents can choose their service level, and pay for it, over time. It all stays here.

- Lower taxes. As long as Dekalb continues to raise taxes, initiate new bonds, this will be true. We vote on higher taxes, but I don't think you're getting a refund.

- More ethical and responsive leadership depends on EVERYONE, not just proponents. The process depends on each citizen to help vet the best candidate, not just one side. If you sit back, cross your arms and hope for the best, you get what you deserve.

I could honestly care less about convincing anyone about anything, I just despise the ingrained negativity from folks that are unwilling to help or give this new City a fair shot at success.

The vast majority of the No people were opposed to the back room tactics and the rush to install a new layer of government without it being fully thought through. You will see that the speed in which this city foundation has to be constructed will prove to be a hinderance to its smooth take off. But you just keep on slamming your gavel and declaring finality in your decision to put your hero J Max Davis in office. I voted for the city, but am very skeptical as to the integrity and character of J Max Davis and Mike Jacobs. They love the old game of hide and seek.

Can't say its a surprise that they are moving this operation next to their new building off Peachtree-Dunwoody. Frankly I'm surprised Cox needs more space, the AJC? But they do own 750 AM and they are getting Rush he must be on Oxycotin.

Mr. Eric, as someone on the “outside” of all the pro-city groups, I am glad to take the bullet for you. You would be surprised what COX and its various subsidiaries are in to demanding additional space, but this is not for the AJC.

And, if we were already a city, and the site decision was still fluid, we would not need a special department to bring business, just a mayor with personality capable of selling the city.

Oh ok Hamburger. Yea we've also got that other highrise pad ready to go plus other parcels but yes they won't build on Spec.

Though the topic I'm curious the Patch hasn't raised and would be interested in discussing is the large Buford Highway project GDOT announced. PEDS feels the median would help. Though I think there are lots of problems with the proposal. The road should be narrowed to 2 lanes in each direction and the speed lowered from 45 to 35, perhaps make the right lane a bus/shuttle/turn lane.

DeKalb is not progressive or aggressive enough in these matters. And Brookhaven is a ways off from having any meaningful influence over GDOT.

Greetings.
I have done extensive research on the topic of speculating others identities on these forums. My research has led me to the conclusion that they are all J Max Davis and Mike Jacobs. It is still unclear whether or not these 2 persons are actually one in the same. After extensive laboratory analysis through a series of experiments, I have concluded that Mike Jacobs can actually fit inside of J Max Davis, thus leading me to believe that J Max Davis is actually only a transport apparatus and docking station for Mike Jacobs. I am also very close to proving that there is actually no persons named J Max Davis or Mike Jacobs...only the one true being who is none other than J Max Jacobs, esq. To complete my research, I am in need of photographic evidence of Mike Jacobs exiting the docking station via the gluteus portal. I had hoped to witness this sublimation during my attendance at the chili cook-off, however, the close proximity of J Max (Jacobs) booth to the portable toilet enclosures, led me to believe I had missed this transformation in it's entirety. Although the lingering odor of flatulance persisted and the attempt to mask the discomfort had by all with a bottle of French's mustard, could not conclusively provide the evidence I could submit to my colleagues for further concurrence.
All of this is very interesting. Again, further evidence is needed to complete this study.

Yes sir. This is a condition that should be closely monitored. Symptoms begin with a swelling of the head. As the condition worsens it affects the digestive tract causing extreme swelling - and in the most acute cases, the stomach will explode. Mr. jonathan, your comments are amusing, if this was on Saturday Night Live you would call this great comedy. Remember, you now have your new city. Why should you be concerned if a few folks are unhappy? Are you aware of something we should know? And, for many of us in the Brookhaven area this is comic relief. Regardless of your take, I got a good laugh out of this. And, I needed the laugh.

SBU, speaking of cynicism . . . And willingness to lie, time will tell, right? Most interesting is how pro-city candidates state the Vinson study was just a roadmap and are now ready to manipulate the Vinson “budget” to make this new city work. I am looking forward to all of those folks completely uninvolved with their county government defend their new city as promises by Brookhaven Yes and its board members are substantially modified.

The various committees are now working on the services our new city will be responsible for. Interestingly, this is based on the Vinson study which has absolutely nothing to do with HB 636. And we have no clue what our actual city budget is, right?

I'm not a pro city candidate. I will tell you that I read the Vinson Study. It better just be a road map b/c the information is not particularly detailed in some areas.

The fact is this is a city whether you take anon pot shots like Spamburglar or not. I am counting on a sh*tpot full of mistakes into the first two years.

Will it beat what dekalb county did? Time will tell. Already I can tell you that more people have paid attention to this part of town in the last 90 days than ---- it seems - the last 3 year in total.

Mr. Tom, you can tell a lot about folks by the way they address others. It is a very little thing that speaks volumes about one’s self and their personal interactions.

As for your reading of the Vinson study, the most important part of this study was what you didn’t read. Unfortunately, most citizens do not have a clue as to what I am talking about. And, this is by design by the folks at C$ND, Brookhaven Yes, and Rep. Mike Jacobs. So, if the sales job was more optimistic than the actual budget will allow, please, don’t complain as no one responsible for this incorrect information wants to hear you or anyone else whine about their dissatisfaction with exactly what was promised to the citizens of this new city. GOOD MORNING!!! Really doesn't matter what we think about the Prez election. Electoral College means Romney wins Georgia. It comes down to the swing states. Can you imagine Georgia voting for Obama? Shoot if I were him I'm not sure I'd want us.

My thoughts? Why thank you. But I will admit, I am not from the new City on the hill, like my alter, I mean neighbors, I mean future annexation mates, I am from the wild blue yonder. So really I'm just here to take pot shots. I thought that was OK seeing how all the grey hairs are doing that!

Oh, ok. One Thought, Vote Wisely. There are many ways to get from Point A to Point B. It is not Rocket Science. It just takes fiscal restraint, some intelligence, a good city manager. Sure if the numbers don't pan well maybe budgets will need to be tighter and some things may take longer, so patience maybe needed.

So are we going to witness a discounting of the CVI Study as time has passed since the city campaign? The one thing we can ALL do is make damn sure we get what we were promised. No one said it would take years and years to fulfill the promises. So they have their city and I want my Utopia. All of it with no excuses. The real kick in the teeth will be when they figure out the HOST allocations they are expecting for 2012 (paid to Brookhaven in 2013) will be ALOT less than they expected. You will see that I am dead on right. Even with shady mathematics the surplus the CVI showed was not achievable. Mike and J Max know full well they lied. 2. Liberals are not the problem, it's their ideas on how to run this, or any other County are not on the side of history or contemporary world scenarios. Greece, Portugal, Spain will all need a rescue loan as their socialist policies are unsustainable. So far, Cityhood is working, large County government is not working.

Nick, you are all over the board.

1. War of Northern Agression? Really? Showing your true colors? The Confederacy was involved in a treasonist war to overturn the United States government and preserve slavery. The Confederacy got its butt kicked. You're not part of "reenactment" battles celebrating you got your butts kicked (again)?
2. Your reference about a "liberal" perspective from the fine folks you mention...so what? Also, please don't be hypocritical. You didn't like it when you were tagged a Rush groupie. You have no clue or knowledge about me to try and put me in your perceived political box.
3. With respect to your expectation that "no voters" now become automatically, compliantly involved, and if not, we are the scum of the earth. Nick, that is unrealistic. I have a very deep level of mistrust as to the manner in which the process for city hood was conducted. I may have been all for it if I felt more community education and input was afforded. I also felt the reluctance to medicate the broad concerns about the CVI study was troublesome.
4. Your Forbes link? What's your point? BTW, when I looked at the comments for that article...3 total. HamBurger gets that many responses when he's not even contributing perspectives.

We live in a time when people associate a tentacle of the University of Georgia (although being a quasi-private entity) with being a 'neutral authority' on the issue of municipalization. Folks don't understand that 'you get the answers you pay for' and the CVI has no dog in the fight once they are paid.

It's like the misguided swath of the population that assumes 'SACS' is a bastion of educational expertise rather than a for profit tentacle of the CofC.

And still, everyone gets to vote.

Eddie E., excellent point. It's not surprising since a significant portion of the Georgia General Assembly are UGA grads. The back and forth back scratching between the state university and GA is expected. Unfortunately Brookhaven got caught in the cross fire of CVI scratching.
